Who decides siting in Michigan
General information about state law as checked on Sep 29, 2026, with sources. Not legal advice; thresholds, exemptions and pending legislation change.
- Under Public Act 233 of 2023 (effective Nov 29, 2024) the Michigan Public Service Commission (MPSC) may issue siting certificates for solar of 50 MW or more, wind of 100 MW or more, and storage of 50 MW and 200 MWh or more (MCL 460.1222).[1]
- A local unit may adopt a “compatible renewable energy ordinance” (CREO), which may be no more restrictive than the Act’s standards (MCL 460.1221).[2]
- A developer may apply to the MPSC if the local unit misses its deadline, denies a CREO-compliant application, or tightens its CREO; a local unit may also ask the MPSC to require a state certificate (MCL 460.1223, 460.1222).[3][1]
- On May 7, 2026 the Court of Appeals (Almer Charter Township v MPSC) largely upheld the MPSC’s implementation of PA 233, which remains in effect.[4]
- 79 townships and counties applied for leave to appeal to the Michigan Supreme Court on Jun 18, 2026; we have not confirmed what has happened since.[5]
- There is no state siting process for data centers; they go through local zoning, and the Michigan Zoning Enabling Act generally bars a township from totally prohibiting a lawful land use (MCL 125.3207).[6]
- PA 207 of 2024 extends the data-center equipment sales and use tax exemption to 2050 (2065 on brownfield or former power-plant sites) with a Michigan Strategic Fund certificate; it is a tax law, not a siting law.[7]
